These Terms and Conditions ("Terms") govern your use of RetroBooth, a photo booth and photo-delivery service (the "Service") provided by RETROMATT SOLUTIONS LLC ("Company," "we," "us," or "our"), including our SMS text messaging program.
By using our photo booth and providing your phone number to receive your photos, you agree to these Terms.
1. The Service
RetroBooth provides on-site photo booth services at private and corporate events. After completing a photo session, you may choose to enter your mobile phone number to receive a text message containing a secure link to view and download your photos.
2. SMS Program Terms
- By entering your phone number and submitting the on-screen form, you consent to receive a one-time SMS from RetroBooth containing a link to your session photos.
- Message frequency may vary. Message and data rates may apply.
- Consent to receive SMS messages is not a condition of purchasing any goods or services from us.
- Reply STOP to any message to opt out at any time. Reply HELP for assistance.
- We do not send marketing or promotional messages through this program, and your information is not shared with third parties for marketing purposes. See our Privacy Policy for details.
3. Photo Ownership and Usage
Photos captured during your session are provided to you for personal use. Company retains the right to use event photos for promotional purposes, excluding any individual who requests exclusion. Please contact us if you would like a photo removed from any promotional use.
4. Availability of Photos and Links
Photo delivery links are made available for a limited time (90 days from your session). After this period, links may expire and photos may no longer be accessible. We are not responsible for photos not downloaded before expiration.
5. No Warranty
The Service is provided "as is." While we make reasonable efforts to ensure timely delivery of your photos, we do not guarantee uninterrupted or error-free service, including delays or failures caused by mobile carriers or network issues outside our control.
6. Limitation of Liability
To the fullest extent permitted by law, RETROMATT SOLUTIONS LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including failure to receive or access your photos.
7. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
8. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws principles.
